Physical commencement occurs when certain building, engineering or subdivision work is carried out to prevent lapse of a DA consent. Achieving physical commencement can be very important as the process of gaining a DA can be quite involved, require specialist inputs and reports and be in regard to the legislation framework at the time of approval which can change. de Witt Consulting recently assisted our client establish physical commencement of their DA. Our client’s rural industry was approved more than 4 years ago but had not been enacted and was at risk of lapsing. de Witt Consulting reviewed the consent conditions, identified actions required, obtained a construction certificate, project managed specialists to complete the necessary works and was able to demonstrate to Council that the DA had physically commenced.
